The WEST VIRGINIA v. EPA Supreme Court ruling confirmed that elected legislatures, not unelected agencies are the legitimate Constitutional mechanism to determine policy.
Contrary to the assumption that the EPA is protecting the environment from air pollution is the fact that programs such as the Federal Weather Enterprise has disabled the agency from functioning for many years:

Continued but reduced attention is being paid to the effects of airborne toxins, ozone, and fine particulate matter on human health, and the impact of air pollution on human health and sensitive ecosystems.” -p.9
States have the power and the responsibility to enact strong laws to tackle pollution.
