The WEST VIRGINIA v. EPA Supreme Court ruling confirmed that elected legislatures, not unelected agencies are the legitimate Constitutional mechanism to determine policy.
Contrary to the assumption that the EPA is protecting the environment from air pollution is the fact that programs such as the Federal Weather Enterprise has disabled the agency from functioning for many years:

States have the power and the responsibility to enact strong laws to tackle pollution.
