End Warrantless Mass Surveillance

May 9, 2023 | Section 702 of the Foreign Intelligence Surveillance Act (FISA) allows government “intelligence” agencies such as the FBI to collect information scooped from phone calls, texts, and emails from Americans – without their knowledge or consent. This policy was formalized in 2008 and has been reauthorized periodically by Congress ever since. Section 702 is set to expire, but Joe Biden is pushing for the law to be renewed.

The FBI has engaged in “widespread violations” according to recent court opinions. Inspector General Horowitz testified during a House Judiciary Committee on April 27th, that more than 1 million secret database searches were conducted “in error” by the FBI in 2021.

Mass warrantless surveillance of Americans is unconstitutional as per the Fourth Amendment: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
